Car Rental Terms and Conditions

LLC Meway App (ID: 405847044), legal address: Tbilisi, Saburtalo district, Vazha-Pshavela Avenue, N30a (hereinafter — "Meway" or "Platform").

This Agreement applies to all vehicle owners or their authorized representatives (hereinafter — "Host") who post a listing on the Meway platform and/or confirm a guest's booking. By confirming a booking, the Host unconditionally confirms that they have fully reviewed and agree to these terms.

Important: Meway is a technology platform that connects Hosts and Guests and administers the payment process (in accordance with applicable legislation and payment system requirements). The rental relationship — including the actual handover of the vehicle, its technical condition, insurance, and any associated risks — exists exclusively between the Host and the Guest. Meway does not act as a lessor/co-lessor of the vehicle and assumes no liability for the vehicle, its condition, or its use.

Scope of Meway's involvement: Meway will intervene in the relationship between the parties exclusively in matters relating to the rental fee and deposit, if the Host and Guest are unable to resolve the issue independently. In such cases, Meway acts as a mediator and, based on the evidence presented, issues a final administrative decision limited to the rental fee and deposit. Any other matters (including traffic/parking fines, vehicle theft, insurance claims, or additional damage claims beyond the deposit) are resolved directly between the Host and Guest, without Meway's involvement or liability.

1. Listings, Data Accuracy, and Moderation

1.1. The Host is solely responsible for the accuracy of all information in the listing — including vehicle specifications, price, availability, insurance status, and additional terms.

1.2. Meway reserves the right to: decline to approve a listing; request corrections to information; temporarily suspend or remove a published listing for violations; restrict listing visibility on technical or internal control grounds.

1.3. If the information in the listing is found to materially differ from reality (e.g. vehicle condition, equipment, price), Meway may cancel an active booking, refund the Guest in full, and apply the sanctions set out in Article 8 against the Host.

2. Guest Personal Data

2.1. Documents shared by the Guest for verification purposes (ID, driver's license) are made available to the Host exclusively for the purpose of identifying the Guest.

2.2. The Host is strictly prohibited from: storing, copying, photographing, screenshotting, or sharing the Guest's personal data with any third party in any form.

2.3. Violation of this article will result in immediate and permanent blocking of the Host's account, removal of listings, and liability under Georgian law ("On Personal Data Protection").

3. Vehicle Condition and Documentation

3.1. The Host must hand over to the Guest a technically sound, clean vehicle that has passed the mandatory periodic technical inspection required by law and fully matches the listing description.

3.2. The Host must ensure all required documents are present in the vehicle (vehicle registration certificate/technical passport and, if applicable, a valid insurance policy).

3.3. Insurance: when adding a listing, the Host indicates whether the vehicle has valid insurance. If the Host does not have insurance, they explicitly agree that any financial risk or loss arising from an accident, damage, theft, robbery, or any other incident shall be borne entirely and without exception by the Host. Meway assumes no role or liability in this regard (including any obligation to verify insurance validity).

3.4. To avoid disputes, Hosts are strongly advised to document the vehicle's visual condition, interior, and fuel level with photos/video at both handover and return. In the absence of adequate evidence, Meway is unable to uphold a Host's claim relating to the deposit.

4. Booking Confirmation

4.1. For standard bookings, the Host has 2 hours to confirm a booking.

4.2. Express booking: if less than 2 hours remain before the rental starts, the confirmation deadline is the time remaining before the start minus 30 minutes.

4.3. If the Host fails to confirm the booking within the required timeframe, the Guest's payment (including deposit) is automatically refunded in full. Since the booking did not proceed, the Host receives no payout, and this is reflected in the Host's rating (see Article 8).

4.4. Failure to confirm an express booking does not affect the Host's rating.

4.5. If 1 hour has passed since the official booking start time and neither party has confirmed vehicle handover in the app, the booking is automatically considered activated by the system, unless an active complaint about the delay has been registered on the platform.

5. Vehicle Return and Deposit

5.1. The Host must immediately confirm the vehicle's actual return on the platform. The 2-hour deposit release window begins from the moment of confirmation.

5.2. If the Host does not confirm the return, the system will automatically confirm the process after a reasonable period following the booking end time, in accordance with the platform's internal rules.

5.3. Deposit claim: if the vehicle has been damaged, has a fuel shortage, significant dirt, or another violation, the Host is first advised to resolve the matter directly with the Guest. If no agreement is reached, the Host uses the "Request from Deposit" function, specifying the requested amount, reason, and attaching supporting photo/video evidence.

5.4. The Guest has the right to reject the claim — in which case the deposit remains held on the platform until mediation is complete. Meway will only intervene at this stage, as a mediator, and will make a final decision regarding the deposit based on the evidence presented (see Article 11).

5.5. If no claim is made, the deposit is automatically returned to the Guest within 2 hours of the Host confirming the return.

6. Late Return, Cleanliness, Fuel, and Fines

6.1. Late return:

•

0–30 minutes — free;

•

30 minutes – 3 hours — 30% of the daily rate;

•

Over 3 hours — full daily rate.

This amount will be deducted from the Guest's deposit. The Host may waive this fee at their own discretion.

6.2. Fuel: the vehicle must be returned with the same fuel level as at handover. If there is a shortfall, the Host may request compensation using the procedure in Article 5.3.

6.3. Hygiene: in the event of smoking, pet hair, or other significant contamination, the Host may request cleaning cost compensation using the procedure in Article 5.3.

6.4. Traffic fines: the Guest is solely responsible for all video, parking, or other administrative fines incurred during the rental period. This matter is resolved directly between the Host and Guest — Meway has no functionality for this and does not intervene, either administratively or as a mediator.

7. Payment to the Host

7.1. The booking fee will be transferred to the Host's bank account after the Guest receives the vehicle (official trip start) — within 24 hours of handover.

7.2. Meway reserves the right to withhold, reduce, or reclaim already-transferred funds if:

•

the vehicle was handed over in a technically defective, dirty, or hazardous condition;

•

the listing information materially differed from reality;

•

a Guest's claim (Articles 5.3–5.4) is substantiated by evidence and relates to the deposit or rental fee.

7.3. Since payment is linked to the actual trip start (Article 7.1), in the event of a failed confirmation (Article 4.3) or no-show (Article 9.2 — "No-Show"), payment is not initiated and the Host receives no compensation.

8. Ratings and Sanctions

8.1. Cancellation of a confirmed booking by the Host reduces the Host's rating on the platform.

8.2. Failure to confirm a booking, posting an inaccurate listing (Article 1.3), or failing to provide the vehicle without a pre-confirmed reason will affect the Host's rating and may result in a temporary restriction on accepting new bookings.

8.3. In cases of systematic violations, Meway may temporarily or permanently block the Host's account.

9. Host Cancellation and No-Show

9.1. Cancellation of a confirmed booking by the Host is only permissible in the event of a force majeure situation (e.g. unexpected vehicle breakdown, theft, sudden serious illness, or other objective circumstances).

9.2. If the Host fails to provide the vehicle at the time and location specified in the booking without a force majeure circumstance (including a No-Show), the Guest's payment (including deposit) is refunded in full and unconditionally. The Host receives no payout for that booking (Article 7.3) and is subject to the sanctions set out in Article 8.

9.3. A repeated No-Show constitutes sufficient grounds for immediate, permanent account suspension without additional warning.

10. Full Transfer of Liability to the Host

10.1. Meway is not the owner, lessor, or insurer of the vehicle and assumes no liability for accidents, mechanical damage, theft, robbery, harm caused to third parties, or traffic/parking fines arising during the rental period.

10.2. Full legal and financial liability for the vehicle, its technical condition, insurance (or lack thereof), and any of the above risks rests exclusively with the Host, except where damage is caused by a confirmed unlawful act of the Guest — in which case the matter is regulated directly between the Host and Guest (with platform mediation or through Georgian courts as appropriate).

10.3. Meway's maximum financial liability to the Host, in any case, is limited exclusively to the amount of the service commission (Commission Fee) actually received by Meway from that specific booking.

10.4. Indemnification: the Host expressly agrees to compensate Meway for any costs, damages, fines, or third-party claims arising from the Host's violation of this Agreement, applicable law, or third-party rights (including inaccurate listings, concealment of lack of insurance, or violation of personal data protection rules).

11. Dispute Resolution and Mediation

11.1. The Host has the right to report a service issue to Meway's support team.

11.2. Meway will intervene in a dispute between the parties (Host–Guest) only if the matter relates to the rental fee or deposit and the parties are unable to reach agreement independently. In such cases, Meway retains the exclusive right, based on the facts and evidence presented (photos/video, correspondence, system logs), to act as a mediator and issue a final administrative decision on deducting, returning, or transferring the deposit. In matters beyond this scope (including fines, direct damage claims, legal disputes), Meway does not intervene.

11.3. A mediation decision made by Meway is binding for the platform's internal financial settlement, but does not limit the Host's right to have the dispute reviewed by the courts of Georgia under applicable legislation.
